A Moroccan lawyer is suing a Salafi Islamist leader for issuing a fatwa that permits marrying off nine-year-old girls. The lawyer is charging Al Maghrawi of violating the laws of the country encouraging the sexual violation of children. He also charged him of defaming Islam with such fatwas.

I’m interested in the latter part, that he is defaming Islam with the fatwa. We know Prophet Muhammad married a young Aisha, so how might the full legal arguments in shariah terms go?

Aisha’s age is not the issue here. By law, a woman has to consent to a marriage in order for it to be religiously legal. Children, also by law, are not responsible for their own actions. The onset of puberty is considered the point at which Muslims become responsible for their actions. Ergo, a prepubescent girl cannot be held accountable for her actions, and thus cannot legally consent to a marriage, and thus cannot be married.
And if you need to hear that spelled out in order to understand that pedophilia is wrong, get your head checked.

I agree much. However, I’d like to know how the Prophet Muhammad becomes the exception to the rule, that muslims cannot follow marrying a “nine year old” girl anymore, even if the girl has reached an early puberty.
